Terms and Conditions

These terms govern the subscription, deployment, support, data handling, and permitted use of PixzarPOS services provided by Pixzarloop Pvt Ltd.

Acceptance of Terms

  • By accepting a quotation or making an advance payment, the client agrees to the functionalities and limitations of the selected plan.
  • PixzarPOS is provided on an “as-is” and “as-available” basis, unless otherwise agreed in writing.

License Grant and Usage Restrictions

  • Pixzarloop Pvt Ltd grants a limited, non-exclusive, non-transferable license to use PixzarPOS.
  • The software license is restricted to the original purchaser and cannot be shared, sold, or transferred to any third party or other business entity under any circumstance.
  • Reverse engineering, duplication, or modification of PixzarPOS is strictly prohibited.
  • All intellectual property rights remain the sole property of Pixzarloop (Pvt) Ltd.

Requirements and Software Deployment

  • PixzarPOS is provided under a cloud-hosted model via a designated subdomain of PixzarPOS.
  • Every package includes four (4) user accounts per subscription/location. Additional user accounts can be added, subject to an extra monthly or annual fee per user.
  • Additional hardware or configurations must be compatible with PixzarPOS and are the client's responsibility when sourced externally.
  • The client must provide a stable broadband internet connection and ensure the presence of an authorized representative during installation or training.
  • Internal wiring and networking are not included and must be handled by the client.
  • Pixzarloop is not responsible for the performance of externally purchased hardware or third-party software.

Installation and Support Services

  • Standard technical support hours are from 8:30 AM to 6:00 PM, Monday to Friday. Extended support from 8:30 AM to 11:00 PM, Monday to Sunday, including holidays, is available for an additional charge.
  • Since this is a cloud-based service, on-site visits are not provided by default during installation. If an on-site installation is requested, two-way transportation charges apply for locations beyond 25 km from the PixzarPOS office in Negombo, at LKR 125 per kilometer. For distances exceeding 100 km one-way, an additional fee of LKR 8,000 will be charged on top of all other applicable charges.
  • Support is provided only for resolving software-related faults or bugs reported during the subscription period.
  • This service excludes support for external hardware faults, ISP-related connectivity or network issues, software misuse or unauthorized modifications, and errors due to lack of user knowledge.
  • Pixzarloop may charge additional fees if support is needed due to client errors or environmental faults.
  • The software may occasionally be taken offline for essential updates and maintenance. Clients will be informed in advance whenever possible. These updates are necessary to enhance performance, security, and overall functionality, and efforts will be made to complete them as promptly as possible. The understanding and support of clients are greatly appreciated as continuous improvements are made to the software experience.

Data Privacy and Backup

  • The client is solely responsible for securing and backing up their data. Pixzarloop does not store client data on its servers beyond the active subscription period. Data will be retained for 30 days after service suspension. After 45 days of non-payment, all data will be permanently deleted without further notice.
  • While the software is designed for reliable performance, we strongly recommend keeping a manual process in place for emergency situations. This ensures that your business operations can continue smoothly in the rare event of unexpected technical issues or disruptions.

Onboarding, Training and Installation

  • A maximum of two (2) private online training sessions will be provided upon request.
  • Additional training can be joined through PixzarPOS group sessions. Extra private sessions incur additional charges.
  • On-site training is not included by default. If requested, additional charges will apply. (Sri Lanka only)
  • The client will be provided with an Excel format for the item list and must submit item details for a one-time upload. PixzarPOS will not be responsible for item entry if this is not submitted.

Termination

  • The client may terminate the subscription at the end of any subscription month/year with written notice. No refunds will be issued for partial month/year cancellations.
  • Pixzarloop may terminate access immediately for:
    • Breach of Agreement.
    • Non-payment.
    • Unauthorized access to the software, unauthorized sharing of content, or disclosing software to any third party.
  • Upon termination, the Client’s license to use PixzarPOS will be revoked by Pixzarloop. Any outstanding payments must be fully settled prior to termination, and no refunds will be issued under any circumstances.

Warranty Disclaimer

  • PixzarPOS is provided in its current version, and while Pixzarloop makes every reasonable effort to ensure software uptime and resolve errors, uninterrupted or error-free service cannot be guaranteed.
  • Pixzarloop does not guarantee compatibility with any third-party software or hardware that is not supplied or accepted by the company.
  • Clients may request updates or modifications to PixzarPOS; however, all such requests are subject to evaluation and approval by Pixzarloop. Any approved modifications or upgrades will be subject to applicable development charges. All development decisions, including scope, feasibility, and implementation, shall be at the sole discretion of Pixzarloop.
  • The client will be provided with an Excel format for the item list and must submit item details for a one-time upload.
  • PixzarPOS is not obligated to provide a replacement for faulty devices even on a temporary basis, until the warranty claim is completed, the warranty period is verified, and the device is either repaired or approved for replacement.

Branding and Publicity Consent

  • Pixzarloop reserves the right to refer to the client as a user of PixzarPOS in marketing materials. All software-generated documents (including e-bills) will include branding in the footer: "PixzarPOS by Pixzarloop - A Contact Number or A Website."

Electronic Communications and Notifications

  • Pixzarloop may provide notifications, communications, or service-related messages to the client via telephone calls, SMS, WhatsApp, e-mail, or in-app/on-screen notifications within the software, at its sole discretion. The transmission or display of a notification by any one of these methods shall constitute full and valid notice to the client.
  • Any e-mail successfully transmitted from the Pixzarloop mail servers and recorded in the sent logs shall be deemed a valid and effective notification, irrespective of whether the client actually receives, accesses, or views such e-mail.
  • Any SMS successfully transmitted through the Pixzarloop SMS gateway and confirmed with a successful delivery response from the gateway shall be deemed a valid and effective notification, irrespective of whether the client actually receives, accesses, or views such SMS.
  • Any WhatsApp message successfully transmitted through the Pixzarloop WhatsApp messaging service and confirmed as delivered shall be deemed a valid and effective notification, irrespective of whether the client actually receives, accesses, or views such message.
  • Any telephone call placed to the contact number provided by the client, regardless of whether it is answered, rejected, missed, or redirected to voicemail, shall be deemed a valid and effective notification.
  • Any in-app or on-screen notification displayed to the client within the software shall be deemed a valid and effective notification at the moment it appears, irrespective of whether the client actually reads or acknowledges it.
  • The client is solely responsible for providing accurate, complete, and up-to-date contact information, including e-mail addresses, telephone numbers, and WhatsApp-enabled numbers. Pixzarloop shall not be liable for any failure to provide notifications arising from inaccurate, incomplete, or outdated contact information.
  • Pixzarloop shall not be held responsible or liable for client-side errors, non-receipt, spam filtering, call unanswered, message not seen, device or network issues, security settings, user inaction, or any other circumstance beyond Pixzarloop’s direct control that may prevent the client from receiving, accessing, or becoming aware of any notification.
  • By using Pixzarloop’s services, the client acknowledges and agrees that notifications sent via telephone, SMS, WhatsApp, e-mail, or displayed in-app/on-screen, as described above, constitute valid and effective communication for all purposes under these Terms & Conditions.

    PixzarPOS is fully aligned with the specifications outlined in the terms and conditions. Clients are encouraged to clarify any inquiries during the live demonstration or by directly contacting the technical team prior to purchasing PixzarPOS. During the pre-purchase period, the support team is available to assist with any questions or clarifications.

    Clients are strongly advised to read and understand the complete documentation provided before making a purchase decision. Clients are responsible for reviewing the product documents thoroughly to ensure the software meets their business requirements before completing the purchase.

    Once the client purchases the PixzarPOS product and payment is confirmed, the setup process of the software will be initiated. The client will receive the product license URL along with a proof of payment.

  • Eligibility This Guarantee is available only to first-time users who create an online PixzarPOS account and purchase a subscription directly through official website. This Guarantee is limited to one (1) claim per customer or business entity.
  • Guarantee Period The Guarantee is valid for seven (7) calendar days commencing from the date of account activation.
  • Refund Request To be eligible, the customer must submit a refund request within the Guarantee Period by sending an email to the official Pixzarloop email address info@pixzarloop.com along with valid proof of purchase. A refund request shall be considered received only upon successful delivery of the email to Pixzarloop’s mail servers. Pixzarloop shall not be liable for any delays, failures in transmission, or non-receipt of emails. Refund requests submitted after the expiry of the Guarantee Period will not be considered under any circumstances.
  • Scope of Refund Only the subscription fee paid for the PixzarPOS Service is eligible for refund. Any setup fees, customization charges, third-party integrations, domain registrations, hosting services, hardware, or additional services are strictly non-refundable.
  • Usage Conditions The Service must be used in accordance with the applicable terms of use. Any misuse, abuse, unauthorized access, modification, or violation of policies will automatically void this Guarantee.
  • Exclusions This Guarantee does not apply to:
    • Renewals of existing subscriptions.
    • Plan upgrades or add-on purchases.
    • Accounts suspended or terminated due to policy violations.
    • Requests based on lack of usage, change of mind, or failure to fully evaluate the system during the Guarantee Period.
  • Deduction Fee A deduction of five percent (5%) of the total payment will be applied to all approved refunds to cover transaction, banking, and processing charges.
  • Processing of Refunds Approved refunds will be processed within five (5) to ten (10) business days. The refund will be issued using the original payment method unless otherwise determined. Pixzarloop shall not be responsible for delays caused by banks, payment gateways, or third-party financial institutions.
  • Right of Review This Guarantee is intended to allow reasonable evaluation of the Service. Pixzarloop reserves the sole and absolute right to review, approve, or reject any refund request based on compliance with these Terms. All decisions made by Pixzarloop in this regard shall be final and binding.
  • Account Suspension During Review Pixzarloop reserves the right to suspend or restrict access to the Service while a refund request is under review.
  • Data Deletion Upon approval of a refund, the Client’s access to PixzarPOS will be terminated, and all associated data may be permanently deleted. Pixzarloop shall not be liable for the recovery, restoration, or retrieval of any data thereafter.
  • Amendments Pixzarloop reserves the right to modify or withdraw this Guarantee at any time. However, any active Guarantee Period will continue to be honored under the terms applicable at the time of purchase.
  • Limitation of Liability This Guarantee represents the sole and exclusive remedy for dissatisfaction with the Service during the Guarantee Period and does not extend to any indirect, incidental, or consequential losses, including loss of business, revenue, or data.
  • Guarantee Period Limitation The 7-day Guarantee Period shall not be extended under any circumstances, including but not limited to technical issues, non-usage, delays in request submission, or failure to access the system.
